Constables

In Pennsylvania, constables perform numerous important functions at the municipal level and are independent contractors, statutorily authorized to perform services for the Courts. Constables are not Court employees. However, pursuant to Pennsylvania Rule of Judicial Administration 1907.2, their conduct is governed, in part, by the Pennsylvania Unified Judicial System: Constable Policies, Procedures and Standards of Conduct Handbook.

Pursuant to York County Rule of Judicial Administration 1907.2(C), the York County Constable Review Board (CRB) is authorized to receive complaints by or against constables regarding the performance of judicial duties, financial/payment disputes or other matters relevant to a constable’s service to the Court in York County. Individuals wishing to file a complaint must do so by writing to the Administrative Office of York County Courts (AOYCC), 45 N. George St., York, PA, 17401. All complaints must be specific, must provide sufficient detail to enable the CRB to determine whether further investigation and action is warranted, must be signed by the individual filing the complaint who has direct knowledge of the facts alleged in the complaint, and must include contact information for the complainant. The AOYCC will neither accept nor act upon vague, unwritten or anonymous complaints.

The District Court Administrator will provide properly filed complaints to all members of the CRB. The District Court Administrator may initiate preliminary investigation and/or recommend temporary action by the Court. Upon motion of any three members of the CRB, the board will convene within 10 business days to evaluate the complaint and initiate any further action the board deems appropriate. Upon conclusion, the District Court Administrator shall notify the complainant of the outcome.
